Firearms License Rules
A U.S. citizen, who has not renounced their citizenship, and who resides in your county;
OR
An resident alien, legally in the U.S., who has resided in the state of Georgia for 90 or more days, and resides in your county is eligible for a firearms license if
Criminal Conditions
- They are not a fugitive from justice,
- They have not fled a jurisdiction to avoid giving testimony in a criminal trial,
- They are not currently under indictment OR have a pending accusation.
- They have no felony conviction;
- for which they HAVE NOT received a full or conditional pardon that restores the right to possess and transport firearms; OR
- the felony conviction has been set aside; OR
- their rights have otherwise been restored by order of a court of appropriate jurisdiction; OR
- their record has been expunged; AND
- they have been free of supervision of that charge for three (3) years.
- They have no conviction of forcible misdemeanor (not including domestic violence offenses for this purpose); or if so they have been free of all supervision for that conviction for five (5) years.
- They have no conviction of:
- carrying a concealed weapon, OR
- carrying a concealed weapon w/o a license; OR
- possessing a weapon at a public gathering; or if so
- they have been free of supervision of that charge for three (3) years.
- They have not been convicted of, nolo-contendere or served First Offender for misdemeanor possession of marijuana. (Atty. Gen Opinion 1997 U-97-29)
- They have no Domestic Violence or Domestic Violence related convictions.
- They have not been dishonorably discharged OR discharged through adjudication of a dismissal in a matter through a general court-martial from the military.
Quasi Criminal-Civil Conditions
They are not subject to a:
1) Temporary Protective Order; 2) Restraining Order; 3) Good Behavior Bond; which prohibits the attempted or threatened use of physical force by the applicant; PROVIDED they were afforded due process in its issuance, including:
1) Notice; 2) a Hearing, and 3) an Opportunity to Participate.
Addiction Conditions
Thy are not current addicts or users of controlled substances (does not include alcohol).
Mental Defective Conditions
- They are not mentally defective unless adjudicated by
A court
A board
A Commission
Or other lawful authority - As a result of
Mental illness
Subnormal Intelligence
Incompetency
Condition or Disease - Defined to include:
In criminal cases or military tribunal found to be
Insane, Incompetent to stand trial, OR Not guilty by lack of mental responsibilityEndangerment to himself or others,
Lacks mental capacity to contract or manage their own affairs; They have not been Committed to a Mental Institution through:
Formal order to receive involuntary treatment, as inpatient or outpatient for
Mental illness, Drug abuse, Alcohol abuse, Combination of all the above, ANDA finding by a court of competent jurisdiction that the subject suffers from such a condition or disease
Whether in civil or criminal proceedings, e.g. 1) in civil commitments, or 2) where a criminal charge has been dismissed, or a sentence reduced, by order or a court on the condition that the person receive treatment for such condition or disease.
